Tax Liens, Tax Deeds and Foreclosure Auctions: A Researcher’s Guide

Classify the event before building your worklist. The words “tax sale” or “foreclosure auction” alone do not identify the records, holding office or claim procedure.

Search results often mix investors buying property, certificate holders collecting interest and former owners seeking surplus funds. Overage recovery research follows the proceeds after the relevant sale. Your first task is to identify what happened and which official record proves it.

Florida: a certificate and a deed mark different stages

The Pinellas County Tax Collector describes tax certificates as interest-bearing liens associated with unpaid real estate taxes. Purchasing a certificate does not itself establish a completed sale of the property or an owner’s surplus balance.

A later tax-deed process may lead to the property being auctioned. The Manatee County Clerk identifies tax-deed sales as property sales for delinquent taxes and links its auction calendar. For research, retain both the certificate identifier and tax-deed case identifier when they apply; they refer to different records.

Florida’s section 197.582 governs tax-deed proceeds, notices and distribution priorities. It includes a 120-day notice-based claim process and an exception for property owners to the late-claim bar. Avoid labeling every Florida balance “expired after 120 days”; verify the claimant category, current holder and applicable procedure.

California: tax-defaulted sales and trustee sales use separate rules

The California State Controller’s auction guidance describes county tax collectors selling tax-defaulted property. For those proceeds, begin with the county’s tax-sale records and the excess-proceeds process. Do not borrow a Florida certificate workflow simply because both records mention delinquent taxes.

A California nonjudicial mortgage foreclosure instead uses a trustee-sale process. Civil Code 2924k sets the proceeds order: permitted sale costs, the foreclosed obligation, junior secured obligations in priority order and then the entitled owner or successor. An auction price above the foreclosed loan balance is therefore not automatically the owner’s payout.

The associated section 2924j addresses notice, claims and unresolved distributions, including court procedures. A mortgage foreclosure file should identify the trustee and any court deposit rather than assume the tax collector holds the fund.

Turn the classification into a research checklist

  1. Save the official notice and mark the sale type and jurisdiction.
  2. Confirm that the sale occurred and preserve the completion evidence.
  3. Identify the holder and exact fund or case identifier.
  4. Find the correct proceeds accounting, instructions and claim-priority rules.
  5. Record the deadline’s triggering document or event, not just a date calculated from an auction calendar.

This classification makes the next research task clearer. A certificate record may need a later sale check; a tax-deed surplus needs the clerk’s file; a trustee-sale surplus needs the trustee’s accounting. Use our overage-list research lesson to build the ledger, then follow the recovery workflow.
